Terms of Service

These Terms are a binding agreement between you and 76 Analytics, Inc. (“76 Analytics,” “we,” “us”) governing your access to and use of PocketPart — the hosted MCP server, dashboard, website, and documentation at pocketpart.io and its subdomains (the “Service”). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy (“AUP”).

1. Definitions

“Organization” is the tenant account that holds a plan, billing relationship, members, and data (a solo user is an Organization of one). “Tools” are the legal-research and utility functions exposed over MCP. “Upstream Sources” are the third-party providers the Service queries on your behalf (CourtListener/RECAP, USPTO, EPO, Cornell LII, govinfo, Exa, PACER). “API Key” is a bearer credential used to connect an MCP client. “BYO Credentials” are third-party credentials you supply (e.g. your PACER login).

2. Account & eligibility

You must be at least 18 and able to form a binding contract. If you use the Service for an organization or firm, you represent that you are authorized to bind that entity, and “you” includes it. You are responsible for the accuracy of your account information, for all activity under your account and API Keys, and for your members’ compliance with these Terms.

3. Acceptable use

Your use is subject to the Acceptable Use Policy, incorporated by reference. Among other things, you may not use the Service unlawfully, share API Keys, circumvent rate limits or entitlements, scrape beyond permitted limits, or violate any Upstream Source’s terms.

4. The Service — what it is, and is not

PocketPart provides legal-research tooling: it lets your AI client search and retrieve case law, dockets, patents, statutes, rules, and related materials, and run utilities. PocketPart does not provide legal advice and is not a law firm. The Service is a research tool, not a substitute for professional legal judgment, and no attorney-client relationship is created by using it. Tool outputs may be incomplete, out of date, or inaccurate, and AI clients can misinterpret or fabricate results. You are solely responsible for independently verifying every citation, holding, status, deadline, and fact before relying on it.

5. Subscriptions, billing, trials, cancellation

Our current plans, features, and prices are listed on our pricing page. Paid plans bill per seat through Stripe; the Firm plan has a 5-seat minimum, and seat changes prorate at the next invoice. Where a trial is offered (Solo includes a 14-day free trial), it converts to paid at the end unless you cancel first. Prices are exclusive of taxes. Some Upstream Sources (notably PACER) charge you directly using your own credentials — PocketPart never marks up those third-party charges. You can cancel anytime via the Stripe Customer Portal; cancellation takes effect at the end of the current period. Except where required by law, fees are non-refundable.

6. API Keys & security

You are responsible for keeping API Keys and BYO Credentials confidential. API Keys are bearer credentials — anyone holding one can act as you. Do not share them, embed them in client-side code, or commit them to source control. Create, label, rotate, and revoke keys in the dashboard, and notify us at support@pocketpart.io if one is compromised.

7. Third-party data sources

The Service retrieves data from Upstream Sources on your behalf. You must comply with each Upstream Source’s terms of use — including those of PACER, CourtListener/RECAP, the EPO, the USPTO, Cornell LII, govinfo, and Exa — including limits on bulk access, redistribution, and commercial reuse. Upstream Sources may change, rate-limit, or discontinue their data at any time. We are not responsible for the accuracy, completeness, or availability of their data, or for charges you incur directly with a provider.

8. Intellectual property

As between you and us, we and our licensors own the Service. We grant you a limited, non-exclusive, non-transferable, revocable right to use it per these Terms. You retain all rights to your own data and content, and grant us a limited license to process it solely to provide, secure, and maintain the Service as described in the Privacy Policy. We do not use your content, queries, or results to train machine-learning models. Underlying legal materials belong to their publishers and Upstream Sources. Feedback may be used without obligation to you.

9. Disclaimers of warranties

THE SERVICE AND ALL TOOL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT RESULTS WILL BE ACCURATE, COMPLETE, CURRENT, OR ERROR-FREE. We do not warrant uninterrupted or secure operation. Some jurisdictions do not allow certain exclusions, so some may not apply to you.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 76 ANALYTICS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, OR FOR DAMAGES ARISING FROM RELIANCE ON TOOL OUTPUTS OR YOUR FAILURE TO INDEPENDENTLY VERIFY RESULTS. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100.

11. Indemnification

You will defend, indemnify, and hold harmless 76 Analytics and its officers, employees, and agents from claims, damages, liabilities, and costs (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, the AUP, or any Upstream Source’s terms, your BYO Credentials or activity with Upstream Sources, or your violation of any law or third-party right.

12. Termination

You may stop using the Service and delete your account anytime. We may suspend or terminate access if you violate these Terms or the AUP, if required by law, or to protect the Service or others. Provisions that by their nature should survive (IP, disclaimers, limitation of liability, indemnification, governing law) survive termination.

13. Changes

We may modify the Service or these Terms. For material changes we will update the date above and provide reasonable notice. Continued use after changes take effect means you accept them.

14. Governing law & dispute resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.

Binding arbitration. Except as stated below, any dispute arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, seated in Delaware. Judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. You and 76 Analytics agree to bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding.

30-day opt-out. You may opt out of this arbitration agreement and the class-action waiver by emailing support@pocketpart.io within 30 days of first accepting these Terms, stating your name and your intent to opt out. Opting out does not affect the rest of these Terms.

Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or other equitable relief in court for infringement or misuse of intellectual property or for unauthorized access to the Service. For any dispute not subject to arbitration, the exclusive venue is the state and federal courts located in Delaware, and the parties consent to that jurisdiction.

15. Miscellaneous & contact

These Terms, with the Privacy Policy and AUP, are the entire agreement regarding the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign in connection with a merger or acquisition.
